Answer: Ohio

In the face of testing backlash, the Ohio Education Department is asking for a federal waiver that would ask select schools to design their own assessments.

The high-performance schools that the department wants to tap for the pilot include ones in the Innovation Lab Network and others that focus on science, technology, engineering and math. These schools are known for their innovation, and the Education Department now wants them to bring that innovation to the testing arena, reports ohio.com

If the waiver is approved, schools would have new tests to take by the 2016-2017 school year.
